NAM to Senate: Confirm NLRB Nominees Now
Filling the open seats on the National Labor Relations Board with President Trump’s nominee James Macy and the reappointment of board member David Prouty will help the body “implement a pro-growth policy and regulatory agenda,” the NAM said ahead of a Wednesday nomination hearing.
What’s going on: The current three-member NLRB is at a quorum, so it can make decisions on cases, but it lacks the three-vote majority required “to enact any new regulatory rulemakings or to overturn precedent,” the NAM told the Senate Health, Education, Labor and Pensions Committee.
- In the absence of that majority, the NLRB cannot make real policy changes, leaving manufacturers subject to antiquated regulations.
- “The NAM supports the swift confirmation of James Macy and the reconfirmation of David Prouty to effectuate positive outcomes on the most critical policy issues facing manufacturers in America.”
About the nominees: Macy is a longtime labor lawyer who joined the Department of Labor late last year as acting head of the Wage and Hour Division, and Prouty is a former union attorney who joined the NLRB in 2021.
- Their nomination follows the December 2025 confirmations of former Boeing labor counsel Scott Mayer and NLRB staff attorney James Murphy.
Moving along: The committee should “move these nominees to the Senate floor as expeditiously as possible,” said NAM Vice President of Domestic Policy Chris Phalen.
